I. How We Collect Your Information

1. Information for the Provision of our Products and/or Services

We need to collect certain personal information from you that is strictly necessary or useful for the provision of our Products and/or Services. The table below sets out the type of information we collect and how we collect it.

Information Provided by Users:

  • Your Account information : You provide your email, or log in for a third-party account (like Facebook), to create an online or application account (“Account”) or subscribe to our communications. If you refuse to provide such information, you may not be able to use the Services properly. When creating your Account, you may be asked to enter certain information, such as: your name, avatar, age, gender, address, telephone number and email address.

  • Customer Support : When you contact us, you can provide us with information about your use of the Services, including information about the Anker electronics and/or consumer products (“Products”) that you own and contact details, so that we can provide customer support. For example, you can send an email to Customer Support that contains information about our Soundcore performance, and other issues.

  • Your voice : When you use one of our voice assisted technology supported Products, such as vacuum cleaner and floor washing machine, with your permission, your voice will be acquired by that Product and then transferred by that Product back to your elected third-party account (“Third-Party Account”) service as a command, such an Amazon Alexa or Google Assistant command, and relay you the requested information.

  • Your posts, comments, and interactions: When you edit your personal homepage in the client, we will collect the community nickname, avatar and other personal information you set. The community provides social interaction function, when you can use the community in the client or web end to post any of your tips, suggestions and product feedback to the square, product circle, we will collect the information you posted, pictures, and display your nickname, avatar, posted content. You can click to follow the authors you are interested in and receive the corresponding content posted by the authors you follow. When you comment and like, we may collect your comment and like data. The relevant data records will be associated with your account.

Product Usage Information:

  • Product monitoring : We collect information about how you set up and use our Products, such as: functions used; operations performed; time, frequency, and duration of your activities within the Services, and any unique identifiers associated with your Product. For example, we collect the time period you connected the Product to the Application and the time of the last connection, as well as what operations you used in the Account, settings, and other functions in our Products.

  • Images and biometric information : If you choose to enable imaging and biometric features in our Products, like security cameras, we will collect and process certain information collected from our Products, such as face images and underlying face prints. This information enables your Product to recognize familiar faces and to notify you of familiar and unknown people. These features may also allow you to utilize the Services to create and save video or photographic images of individuals. Depending on where you live and how you configure the Products and Services, you may need to get explicit consent before using our Products to create and save video or photographic images and/or scan and match the faces of people.

Device and Other Automatically Collected Information:

  • Device properties and operations : We collect certain information from and about your smartphone, tablet, or personal computer (“Device”), such as: Device number, model, hardware and software version, signal intensity, Internet Protocol (IP) addresses, and other information. We also collect information about the operations you perform on the Device, such as time, frequency, and duration of use.

  • Server logs : A server log is a list of the activities that a server performs. Anker’s servers automatically collect and store in server logs certain information, such as: your search queries, IP addresses, hardware settings, browser type, browser language, the date and time of your request, referral URL, and certain cookies that identify your browser or Account.

  • Web beacons : A web beacon (also called a pixel tag or clear GIF) is computer code that communicates information from your Device to a server. Some of Anker’s Services and communications may contain embedded web beacons that allow a server to read certain types of information from your Device, such as: the number of people who have viewed certain content, when you opened an email message, and your Device IP address. Web beacons help Anker develop statistical information to provide better and more personalized content.

  • Analytics services : Anker also uses analytics services, such as Google Analytics, to collect and analyze your information. Generally analytics services do not identify individual users. Many analytics services allow you to opt out of data collection.   • Cookies : Cookies are small text files that are sent to or accessed from your web browser or your computer’s hard drive. A cookie typically contains the name of the domain (internet location) from which the cookie originated, the “lifetime” of the cookie (i.e., when it expires) and a randomly generated unique number or similar identifier. A cookie also may contain information about Device, such as: user settings, browsing history, and activities conducted while using the Services.Our Services use the following cookies:

Strictly necessary cookies, which are required for the operation of the Services. Without them, for example, you would not be able to use your Account.

Analytical/performance cookies, which allow Anker to recognize and count the number of visitors, learn how visitors navigate the Services, and improve the Services.

Information From Third Parties :

We collect and use information obtained from Facebook, Google, Amazon, Apple and other accounts you use to login to the Services (“Third-Party Accounts”), such as: your name, your user name or handle, birth date, picture, and other details you may have on your Third-Party Account profile. We do not have access to your Third-Party Account passwords.

2. Legal Basis for EU/EEA Users

The purposes for which we Process Personal Data, if you are Subject to the GDPR, and the legal bases on which we perform such Processing, are as follows:

  • Perform our contractual services or prior to entering into a contract with you: If you order products or services from us or if you contact us to request our products or services, we use your Personal Data to provide you with these products or services, including for account and contract management, to facilitate user benefits and services, including customer support and process payment for our products and services or with information that may be relevant for you to decide on whether you want to order our products and services;

  • Justified by our legitimate interests: The usage of your Personal Data may also be necessary for our own business interests. For example, we may use some of your Personal Data to update and monitor the services, or diagnose or fix technology problems; help maintain the safety, security and integrity of our property and services, technology assets and business; enforce our terms, resolve disputes, carry out our obligations and enforce our rights, and protect our business interests and the interests and rights of third parties; and prevent, investigate or provide notice of fraud or unlawful or criminal activity.

  • Consent: In some cases, we may ask you to grant us separate consent to use your Personal Data. In this case, you can revoke your consent at any time with effect for the future.

  • Compliance with legal obligations: We are obligated to collect or retain certain Personal Data because of legal requirements, for example, tax or commercial laws, or we may be required by law enforcement to provide Personal Data on request.

II. How We Use Your Information

We process your personal information as necessary for the provision of our Services and the performance of our contract with you. For example, we need to process your personal information to enable the following:

  • Fulfill our contractual obligations, to deliver the products and services you have requested, including facilitating your messages to other users or groups and for account and contract management (including customer support);

  • Communicate with individuals, including via email, text message, social media and/or telephone and video calls;

  • Review our business performance;

  • Market our products and services to businesses and individuals, including through email, direct mail, phone, text message or online advertising. This may include targeted advertising and retargeting;

  • Administer, improve and personalize our products and services, including by recognizing an individual and remembering their information when they return to our Services and analyzing our customer base;

  • Process payment for our services;

  • Conduct market research;

  • Opportunity tracking, conversion and lead generation;

  • Test, enhance, update and monitor the products and services, or diagnose or fix technology problems;

  • Help maintain the safety, security and integrity of our property, products and services, technology assets and business;

  • Enforce our contractual rights, including without limitation, and to the extent applicable, the Anker Terms of Service, General Terms and Conditions, Software Terms of Service; any addenda thereto or other applicable terms.

  • Resolve disputes, carry out our obligations and enforce our rights, and protect our business interests and the interests and rights of third parties;

  • Prevent, investigate or provide notice of fraud or unlawful or criminal activity; and

  • Enable functions of our Sites or Applications, including creating profiles, using our online-shop and rating products.

  • Display certain functionalities of our Sites or Apps in connection with third parties, such as the trusted shop banner, shipment tracking or product videos;

  • Enable you to use certain functionalities of our products;

  • Offer discounts to certain groups, such as students;

  • Decide whether to enter into a business partnership, such as the affiliate program or the merchant program;

  • Comply with legal obligations.

We may combine information we obtain about you for the purposes described above. We may also use the information we obtain for other purposes for which we provide specific notice at the time of collection or otherwise with your consent.

III. How We Share Your Information

Some parts of our services rely on the following third-party service providers and thus require us to share some of your personal information with them. These third-parties are subject to confidentiality obligations, limiting their use and disclosure of your information.

2. Legal compliance

We may share your personal information in certain circumstances, including:

  • To law enforcement authorities, government or public agencies or officials, regulators, and/or any other person or entity with appropriate legal authority or justification for receipt of such information, if required or permitted to do so by law or legal process;

  • When we believe disclosure is necessary or appropriate to prevent physical harm or financial loss, or in connection with an investigation of suspected or actual fraudulent or illegal activity;

  • When the information is required for the prevention, investigation, detection or prosecution of criminal offences or the execution of criminal penalties, or for the enforcement of civil law claims.

3. Transfers

If the ownership of all or substantially all of our company’s business, or individual business units or assets owned by our company that is related to the Services, were to change, or a bankruptcy or other change were to occur, your Personal Information may be transferred to the new owner or may be shared during such transaction (such as during due diligence) even if such transaction is not completed. In any such transfer of information, your Personal Information will remain subject to this Privacy Notice unless and until changed according to the terms herein.

Our device-sharing function allows you to share information with other people. You have control over how you share and to whom you share your information. We recommend you only share information with people you trust.

We Process Personal Data to contact you via email, telephone, direct mail, or other communication formats to provide you with information regarding Sites, Applications, products, and services that may be of interest to you. If we provide Sites, Applications, products, or services to you, we may send or display information to you regarding our Sites, Applications, products, or services, upcoming promotions and other information that may be of interest to you, including by using the contact details that you have provided to us, or any other appropriate means, subject always to obtaining your prior opt-in consent to the extent required under applicable law. You may unsubscribe from specific promotional email campaigns at any time by simply clicking on the unsubscribe link included in every promotional electronic communication we send, or you may unsubscribe from all Anker promotional emails by unsubscribing online at https://passport.anker.com/unsubscribe. After you unsubscribe, we will not send you further promotional emails in connection with the email campaigns you have unsubscribed from, but in some circumstances we will continue to contact you to the extent necessary for the purposes of providing any Sites, Applications, products, or services you have requested or in connection with any email campaigns to which you remain subscribed.

You may unsubscribe from specific promotional text campaigns at any time by replying STOP via text message to any of the promotional text communications we send in relation to the specific campaign you would like to opt out from. After you unsubscribe, we will not send you further promotional text messages in connection with the text campaigns you have unsubscribed from, but in some circumstances, we will continue to contact you to the extent necessary for the purposes of providing any Sites, Applications, products, or services you have requested or in connection with any text campaigns to which you remain subscribed.

VII. Children’s Data Protection

About the protection of juveniles’ personal information. The company attaches great importance to the protection of juveniles’ personal information. If you are a juvenile under the age of 16 (according to the legal requirements of EU member states, the minimum age must not be less than 13 years old), you must obtain written consent from your parent or legal guardian before using this product and service. This product and service will protect the personal information of juveniles in accordance with the relevant EU laws and regulations.

The Services are not directed to or intended for use by minors. Consistent with the requirements of applicable law, if we learn that we have received any information directly from a minor, we will take steps to delete or destroy that information. California minors : While the Services are not intended for anyone under the age of 18, if you are a California resident who is under age 18 and you are unable to remove publicly-available content that you have submitted to us, you may request removal by contacting us at: support@anker.com. When requesting removal, you must be specific about the information you want removed and provide us with specific information, such as the URL for each page where the information was entered, so that we can find it. We are not required to remove any content or information that: (1) federal or state law requires us or a third party to maintain; (2) was not posted by you; (3) is anonymized so that you cannot be identified; (4) you don’t follow our instructions for removing or requesting removal; or (5) you received compensation or other consideration for providing the content or information. Removal of your content or information from the Service does not ensure complete or comprehensive removal of that content or information from our systems or the systems of our service providers. We are not required to delete the content or information posted by you; our obligations under California law are satisfied so long as we anonymize the content or information or render it invisible to other users and the public.

Because of the international nature of our business, we transfer Personal Data within the Anker group, and to third parties as noted in Section (III) above, in connection with the purposes set out in this Notice. For this reason, we transfer Personal Data to other countries that may have different laws and data protection compliance requirements than those that apply in the country in which you are located, including China, the EEA, the UK, and the US. XI. Cookies, Analytics and Tailored Advertising

Anker and its third-party partners and providers use cookies and similar technologies to automatically collect certain Personal Data when you visit or interact with our Sites and services to enhance navigation, analyze trends, administer the Sites, track users’ movements around the Sites, gather demographic information about our user base as a whole, and assist with our marketing efforts and customer service.
